1. Introduction
Welcome to VibeCanyon ("Platform"), a marketplace for digital products created with the aid of artificial intelligence — including templates, applications, plugins, and other digital assets.
The Platform is operated from Italy / European Union. By using VibeCanyon, the user fully accepts these Terms of Service ("Terms"). If you do not agree with any part of the Terms, please do not use the Platform.
2. Account and User Responsibilities
- To use the main features of the Platform, you must create an account by providing truthful and up-to-date information.
- The user is responsible for the security of their login credentials and for all activity performed through their account.
- Creating multiple accounts to circumvent limitations or bans imposed by the Platform is prohibited.
- VibeCanyon reserves the right to suspend or delete accounts that violate these Terms.
3. Purchases and Licenses
VibeCanyon is a marketplace exclusively dedicated to digital products. No physical goods are sold.
3.1 License Terms
- Each purchase grants an unlimited personal use license: the buyer may use the product for an unlimited number of personal or commercial projects of their own.
- The license does not permit resale, redistribution, or sub-licensing of the product itself (neither in its original form nor in a substantially unchanged form).
- The buyer may use the product as a basis to create derivative works, provided that the final result is not a competing product directly resaleable on VibeCanyon or similar platforms.
3.2 Delivery
Digital products are made available for download immediately after payment confirmation. Access to purchased files is guaranteed through the user's dashboard.
4. Selling Products
4.1 Seller Responsibilities
- The seller warrants that they hold all necessary rights to commercialize the products they publish.
- Products must be functional, properly documented, and consistent with the description provided on the product page.
- The seller is solely responsible for post-sale support related to their own products.
4.2 AI Transparency Obligation
Sellers must clearly and transparently declare which artificial intelligence tools were used in the creation of the product, by completing the mandatory AI Transparency Card provided by the Platform.
4.3 Content Requirements
- Every product must include an accurate description, screenshots/previews, and technical documentation.
- The seller must specify the tech stack, system requirements, and any dependencies.
5. Payments and Fees
- All payments are processed through Stripe, in compliance with their terms of service and PCI-DSS security standards.
- VibeCanyon retains a 30% commission on each sale. The remaining 70% is credited to the seller according to the timelines set by Stripe Connect.
- Prices are shown inclusive of VAT where applicable. Managing the seller's tax obligations is the sole responsibility of the seller.
6. Refund Policy
In accordance with European consumer rights legislation (Directive 2011/83/EU), the right of withdrawal applies within 14 days of purchase.
However, pursuant to Article 16(m) of the same Directive, the right of withdrawal does not apply to digital content the performance of which has begun with the consumer's express consent and acknowledgment of the loss of the right of withdrawal.
In practice: if the product has been downloaded, a refund may only be granted in cases of a serious defect or non-conformity with the description, at VibeCanyon's discretion following verification.
7. Intellectual Property
- The Platform's content (brand, logo, design, VibeCanyon source code) is the exclusive property of VibeCanyon.
- Products sold remain the intellectual property of their respective sellers, who grant a usage license to buyers under the terms set out in Section 3.
- The buyer does not acquire intellectual property rights over the product, but solely the right to use it within the limits of the license granted.
8. Prohibited Content
It is strictly prohibited to publish or sell on the Platform products that:
- Infringe the intellectual property rights of third parties (copyright, trademarks, patents).
- Contain malware, malicious code, backdoors, or intentional vulnerabilities.
- Promote illegal activities, discrimination, violence, or inappropriate content.
- Collect users' personal data without their informed consent.
- Are unauthorized copies or substantially identical versions of products already present on the Platform.
- Violate the EU Artificial Intelligence Regulation (AI Act) or other applicable legislation.
9. Limitation of Liability
VibeCanyon operates as an intermediary between sellers and buyers. The Platform:
- Does not guarantee the quality, suitability, or functionality of products sold by individual sellers.
- Is not liable for direct, indirect, incidental, or consequential damages arising from the use of purchased products.
- Strives to ensure service availability, but without a guarantee of uninterrupted continuity ("as is").
VibeCanyon's total liability towards the user is in any case limited to the amount actually paid by the user in the 12 months preceding the event giving rise to the dispute.
10. GDPR Compliance
VibeCanyon processes users' personal data in compliance with Regulation (EU) 2016/679 (GDPR). For full details on data processing, please refer to our Privacy Policy.
11. Dispute Resolution
- In the event of a dispute, the parties agree to first attempt an amicable resolution by contacting VibeCanyon support.
- If an amicable resolution is not reached, disputes shall be subject to the exclusive jurisdiction of the competent court under Italian law.
- Consumers residing in the EU may also use the European Commission's ODR (Online Dispute Resolution) platform: ec.europa.eu/consumers/odr.
12. Governing Law
These Terms are governed by Italian law. For matters not expressly covered herein, the provisions of the Italian Civil Code and European legislation on e-commerce and consumer protection shall apply.
13. Changes to the Terms
VibeCanyon reserves the right to modify these Terms at any time. Material changes will be communicated via email or Platform notification with at least 30 days' notice. Continued use of the Platform after such period constitutes acceptance of the updated Terms.
